The personalized matchmaking services offered by koode.com are provided by Oparis Technologies LLP, and are effective as of the date you sign up for the koode.com package for the duration of the applicable package that you choose (and is listed on this website). During the Tenure, koode.com will be an endeavour to assist you in finding your better half (prospect) through searching, short-listing, and contacting prospects.
 
koode.com acts as a platform to enable any user to themselves register on it (by filling in the mandatory fields and optional fields, if any) to voluntarily search for profile(s) from the database of koode.com’s already registered users, for seeking prospective lawful matrimonial alliances for themselves. You could also be able to build your profile at the koode.com retail location, but you will need a working email address and a cell phone number. For the benefit of its members and customers, koode matrimony.com's database of profiles is generally categorized by language and area. According to the partner preferences you provide (on the website/applications -(App), members are given free or paid access to browse profiles from the database of koode matrimony.com, and you can select the profiles in which you are interested.

2. 18 years or above (if you are a woman) or 21 years or above (if you are a man);
3. If you have applied for Divorce, you may register on our website/App by stating "Awaiting Divorce".
4. If you are a resident of any other Country, you are legally competent to marry as per the local rules applicable to your country and you shall comply with the Indian laws for marrying a person of Indian Origin
5. c) In case you are a Registrant of the prospective bride/bridegroom and has created a profile in koode.com Website/App on behalf of them or is accessing the koode.com Website/App on behalf of them, it implies that you have taken their consent for their profile creation in koode.com and for accessing the koode.com Website/App.

Registration

1. a) Prior to registering, users must first read, comprehend, and agree on the terms and conditions.
   b) You are expected to complete the online registration process honestly and faithfully by providing true, accurate, current, and complete information. You are also expected to upload recent photos of yourself that will help you meet your expectations. Please read the relevant column before entering any information, choosing an option, or uploading a photo. You could be prompted to supply further information by koode.com, and you can choose to do so. Additionally, you can enter your phone number and email address in any of our registration campaigns that appear on different websites as part of our promotions. Based on this information, our Customer Service Center may call you and help you register your profile on our website or app.
   c)Additionally, koode.com reserves the right to deny registration for your profile on its website or mobile application if it contains your contact information or links in a prohibited area or if there are any errors in the information provided by one of its users.
   d) You acknowledge and confirm that the sole purpose of your registration with koode.com and the use of its services is to find a spouse, and for no other reason. Only individuals who have registered as members of koode.com are eligible for membership. Non-members of koode matrimony.com may not engage in similar or competitive activity, nor may they use the Service or member information for any commercial purpose. The koode Matrimony website maintains the right to take appropriate legal action for violations of these prohibitions. We do not allow the registration of duplicate profiles of the same person in the koode matrimony.com Website/App and have full rights to suspend or terminate (without any notice) such duplicate profiles.

Account Security

As a company, koode matrimony.com does not request passwords, and you are advised not to disclose your password to anyone. You are in charge of maintaining the privacy of the login information you use to access koode matrimony.com, such as your username, password, one-time password (OTP), etc. You consent to take ownership of all actions taken through your account.

Role and Responsibility of koode matrimony.com

 
a)Koode matrimony.com is act as a mediator or provides an interface to its registered members to search for their prospects themselves without any assistance.
b) Koode matrimony.com cannot guarantee or assume responsibility for any specific results from the use of the data available from the Koode matrimony.com service or from other matrimonial websites owned by Nike online. 
c) Any member of Koode matrimony.com may search for profiles, and the results of that search are automatically produced matches based on your partner preferences by Koode matrimony.com. The automatic system-generated prospect results of the Website/App may also vary in accordance with any changes made by a Koode matrimony.com user to their partner preferences.
d) We are unable to completely protect user data while it is in transit or stop any malicious third parties from interfering with the data before it reaches the Koode matrimony.com servers.
e) No Koode matrimony.com member is prohibited from expressing interest in your profile or contacting you depending on their partner preference. However, you have the freedom to deny their interest or proceed further if you are interested.

Role and Responsibility of Koode matrimony.com Member

1. a) Members of Koode matrimony.com are required to upload the most recent photos, which should not be older than three (three) months, to receive better responses. Giving out outdated pictures, pictures of other people, or erroneous or fraudulent information is considered to be breaking the terms and conditions, and Koode matrimony.com is still entitled to its rights under paragraph 2(b) of these terms and conditions.
    
   b) Members are urged not to engage in any business dealings with prospects. Members of Koode matrimony.com are not permitted to ask for or give money to other Koode matrimony.com members. When communicating with another individual, using abusive language is regarded as a breach of the terms and conditions.
    
   c)As a free member of Koode matrimony.com, you agree to regularly log in to your profile on the website or app and send automated messages to potential partners expressing your interest in them. If you have chosen a paid Koode matrimony.com package, you can send personalized messages to potential partners expressing your interest or responding to their inquiries. A member of Koode matrimony.com is also able to read and respond appropriately to messages and expressions of interest sent to them by potential partners.
    
   d)Any changes to the information provided in the customer's profile that is not updated on the Koode matrimony.comwebsite or mobile application may result in the suspension of their membership.
    
   e)When his or her marriage is legally consummated, they should either erase their profile directly or notify customer service so that it can be done.
    
   f)You won't publish or send any content that is threatening, offensive, sexually explicit, or against the interests of the country. If any illegal or offensive content is discovered, Oparis Technologies maintains the right to suspend your profile and may also start the proper legal actions against you.
    
   g)All users must submit a profile that includes all the details needed to create a matrimonial profile. Oparis Technologies  won’t be responsible for any harm or loss resulting from the omission of marriage-related information.
    
   h) Oparis Technologies makes no claims as to the legitimacy or legality of any content submitted by users. Age, occupation, religion,caste or creed, and other personal information may be included in this.
    
   i)It is forbidden to use bots, EXEs, CGI, or other programs or scripts to see content on koode matrimony.com or its members' profiles or to contact, interact, or respond to them.

Medium of Communication with Koode Matrimony Members

The member of Koode Matrimony hereby agrees to receive communications, including promotional communications, from Oparis Technologies or other portals controlled by Oparis Technologies or their alliance partners by any form of contact, including electronic mail, calls, SMS, or WhatsApp messaging.

Through its automated system, koode Matrimony sends to its member (s) prospect profile (s) via photographs, documents, messages, and links. Koode Matrimony member acknowledges that the contact number provided for verification, or an alternate number, if one is offered, is not on the National Customer Preference Register or the Do Not Disturb list, and they agree not to file a complaint.

You have the option to set the frequency of your communications with Koode Matrimony, such as fortnightly, exclusively on weekends, etc. By checking the suitable option on the website or app, you can also choose not to receive calls or texts from Koode Matrimony, provided that you agree to be contacted by a relationship manager of the assisted service or elite service if your profile is one that has been shortlisted for their registered users

Disputes between Members

 
Koode matrimony.com Members are completely in charge of communications (by any means) with prospects or the other way around. Koode matrimony.com expressly disclaims any liability or responsibility for any financial transaction(s), exchange(s), interaction(s), or passing of information(s), etc. between any koode matrimony.com members via email, chat, interaction, WhatsApp, or any other method of communication between   koode matrimony.com members whether using the website/app or otherwise.

 
Content Right
 
You accept that you alone are accountable and liable for the mandatory or optional information you provided on our website and information, such as the profile details, photo, and other content(s), keyed in the appropriate field of the Website or App at the time of creating the koode matrimony.com profile or subsequently modified by you. You also acknowledge responsibility for all posts and communications, such as personalized messages sent by Koode matrimony.com paid members with other users (s). You acknowledge that koode matrimony.com may, in some circumstances, and in its sole discretion, impose restrictions on any member's ability to communicate with other members.
 
 
Third-Party website
 
The members of koode matrimony.com acknowledge and agree that koode matrimony.com may also permit third parties to offer koode matrimony.com members services on the Website/App, and koode matrimony.com may also collect payment for such third-party services from you, and koode matrimony.com may also have revenue-sharing arrangements with such a third party. However, in no case shall koode matrimony be liable to you for such third-party services.

Any moment it sees fit and without prior notice, koode matrimony.com maintains the right to add, delete, alter, modify, or suspend any or all of the koode matrimony.com Services. Members of Koode matrimony.com can anticipate seeing the modification on the website/app.
 

Limitation of liability

In accordance with clause 2(b) of these terms and conditions, we retain the right to suspend your profile and request a refund of any and all fees you have paid for Koode matrimony.com services. If you make a false complaint about another prospect on our website or app, and we decide to suspend or delete that prospect's profile as a result of your complaint, we reserve the right to take appropriate legal (Civil/Criminal) action against you and demand payment for all costs associated with your careless, fraudulent, illegal, or unlawful behavior. Additionally, as stated in clause 2(b) of these terms and conditions, we reserve the right to suspend your profile and delete any and all payments you have made for the Koode matrimony.com services.

Indemnity

You agree to indemnify and hold harmless Koode matrimony.com, its affiliates, officers, directors, consultants, employees, and other partners against any loss, risk, claim, or demand, including reasonable attorney's fees, made by any outsider or third party resulting from or arising from your use of the Service in violation of this Agreement as well as from any violation of these Terms of Use and any breach of your representations and warranties.
 
By using our Koode matrimony.com services, you consent to defend, indemnify, and keep harmless Koode matrimony.com, its subsidiaries, affiliates, directors, officers, agents, and other partners and employees from any loss, damage, responsibility, claim, or demand made by any person through improper use of the services, including reasonable attorney's costs.
 
Termination
 
Koode matrimony.com shall not be liable to you in any way, including for any loss, costs, expenses, or consequence if any, if we receive any complaint against you and as a result has suspended or removed your profile in good standing. Your right to use or access the website/service upon termination or suspension of membership expires immediately. All sections of these terms and conditions, including without limitation the disclaimers and liability limitations, which by their nature should survive termination, shall survive termination. Any obligations that you have that arose or accrued prior to the termination of your access to and use of the Services shall survive such termination.
 
Jurisdiction and Applicable Law
 
The Koode matrimony.com Members unconditionally agree that all such disputes and/or differences if any shall be governed by the Laws of India and submitted to the exclusive Jurisdiction of the appropriate court of law in Vadakara, Calicut, Kerala, India. The registration of Koode matrimony.com membership and all Koode matrimony.com services are deemed to have been entered into within the territorial Jurisdiction of Vadakara, Calicut, Kerala, India.
 
Mode of Payment
 
Koode matrimony.com uses third-party payment gateways for collection payment through credit/debit cards or other payment instruments. Payment made by cash/cheque / Net Banking / Debit / Credit Card/ PayPal/ RTGS/ NEFT/ would be in accordance with the prevailing RBI guidelines. Activation of paid Koode matrimony.com service shall be subject to the realization of the said payment. In case of dishonour of the Cheque/demand draft; you shall be liable to pay the applicable bank`s cheque/DD bouncing charges. Further Koode matrimony.com service to your account will be deactivated/suspended until you settle the value of the payment and applicable bank charges in cash.

Fair usage policy on interest for free members:

free members acknowledge that they have not paid any charges for using the services and for better governance, the number of interests that can be shared by a free member will be restricted, and once the number reaches a particular limit, they will not be entitled to send further interests.

Refund and Assignment

Koode matrimony.com members shall not assign or transfer your Koode matrimony.com membership to any other person or entity, and such an act shall be treated as a violation of terms and conditions and koode matrimony.com shall retain their right under clause 2 (b) of this terms and conditions. The payments made by any Koode matrimony.com members by way of membership/renewal fee/auto renewal are treated as non-refundable
 
Force Majeure
 
 Oparis Technologies shall have no liability to you for any interruption or delay in access to the Site irrespective of the cause.

Koode matrimony.com members shall not assign or transfer your Koode matrimony.com membership to any other person or entity, and such an act shall be treated as a violation of terms and conditions and koode matrimony.com shall retain their right under clause 2 (b) of this terms and conditions. The payments made by any Koode matrimony.com members by way of membership/renewal fee/auto renewal are treated as non-refundable

The portal does not state any authority over the content that is posted on the website. It also does not take any responsibility for error, deletion, omissions, interruptions, delay in the process of transactions, line failures in communication, theft, or unauthorized access to any information of a member/visitor. The services provided are available in the AS-IS form.
The portal does not take any responsibility for the conduct of any user.
 
Age Criteria:

To register as a member of Koode.com or use this Site, you must be of legal marriageable age as per the laws of India (currently, 18 years and above for females and 21 and above for males.) The website is only to facilitate lawful marriages between persons who are legally competent to enter into matrimony under the laws to which they are subject.


 The legal use of view contacts:

 Male :

Male members can view the contact details of female members who are up to 15 years younger than themselves. If the age difference exceeds this limit, contact details cannot be viewed unless permitted under the platform’s applicable policies. If the recipient accepts your interest, you may contact them. If your interest is declined, you will not be able to view or access their contact details.
 
Female :

Female members can view the contact details of male members who are up to 15 years elder than themselves. If the age difference exceeds this limit, contact details cannot be viewed unless permitted under the platform’s applicable policies. If the recipient accepts your interest, you may contact them. Additional terms and conditions applicable to Non- Resident Indian customers.
 
A. Jurisdiction
Laws of India shall be applicable.

B. Arbitration of Disputes

The Parties shall discuss among themselves and resolve any disputes informally. We are interested in attempting to resolve any Disputes by amicable and informal means, and we encourage you to contact us before resorting to arbitration. If the dispute is not resolved within 30 (thirty) days from the date of such dispute, then such dispute may only be resolved through an individual arbitration conducted in accordance with the provisions of The Arbitration and conciliation Act, 1996, by a sole arbitrator. The seat of Arbitration shall be held in Vadakara, Kerala, India. We shall appoint the sole arbitrator. The arbitration proceedings shall be conducted in the English language.
C.However, Disputes relating to infringement of our intellectual property rights, which we may elect to have resolved by means other than arbitration
D.In case of Renewal, Customer is charged the current price that prevails, and renewal is done only for 3 months duration irrespective of the past package.
 E. Enforcement
Any proceeding to enforce this arbitration agreement may be brought in the Courts of Vadakara, Kozhikode, Kerala, India.

RCS Consent

By providing your details during sign-up, you consent to receiving promotional communications via SMS, RCS, email, and other channels.

 Standard against Child Sexual Exploitation and Abuse

A. To ensure the safety and protection of Children, our platform is intended for use only by individuals aged 18 and older. We do not permit Children under the age of 18 to access or use our App.

B. We prohibit posting, uploading, or sharing any content that depicts, promotes, or exploits children in any form, including child pornography or any form of sexual abuse. We scan all user generated content to prevent illegal material including CSAM (Child Sexual Abuse Material) from being uploaded, shared or distributed and our app takes appropriate action by removing CSAM after obtaining actual knowledge of it, in accordance with published standards and relevant laws.

C. Any content violating our Child Safety standard will result in immediate suspension of membership.

D. We provide a mechanism within our app for users to submit feedback, concerns, or reports on CSAM by mailing to [email protected] and we have a strict process to deal with it. Users can also report such instances to National Cyber Crime Reporting Portal at https://cybercrime.gov.in.
